Terms of Service

1. Acceptance of Terms

By accessing or using the Kello platform, API, or website (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, you must not access or use the Service. These terms apply to all users including free-tier, Pro, and Platinum subscribers.

2. Service Description

Kello provides structured, normalised data about the luxury watch grey market via a REST API. This includes:

• Watch specifications (case dimensions, movement, materials)
• Grey-market pricing aggregated from public listings
• Historical price trends and market analytics
• Brand and collection editorial metadata

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. API Usage & Acceptable Use

Your API token is personal and non-transferable. You must not:

• Share, resell, or sublicense API access or raw data to third parties
• Attempt to circumvent rate limits or access controls
• Use the Service for automated price manipulation or market distortion
• Reverse-engineer or scrape the Kello website beyond API access
• Use the data for any unlawful purpose

Violation of acceptable use policies may result in immediate account suspension without refund.

4. Subscription Plans & Billing

Kello offers the following subscription tiers:

• Free: 50 records per request, strict rate limits
• Pro ($59/mo): 500 requests per day
• Platinum ($79/mo): 1,500 requests per day

Subscriptions are billed monthly in advance. You may cancel at any time; access continues until the end of the current billing period. No prorated refunds are issued for partial months unless required by law.

5. Data Accuracy Disclaimer

Kello aggregates and normalises data from public grey-market sources. While we strive for accuracy, watch pricing data is volatile and may not reflect real-time market conditions. Data should not be used as the sole basis for financial, insurance, or appraisal decisions. Kello makes no warranties regarding the completeness, accuracy, or fitness for a particular purpose of any data provided.

6. Intellectual Property

The Kello platform, branding, editorial content, API structure, and normalised datasets are the intellectual property of Kello. You are granted a limited, non-exclusive, non-transferable licence to access the API for lawful purposes in accordance with your subscription plan. All other rights are reserved.

7. Limitation of Liability

To the fullest extent permitted by law, Kello shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service. Our total aggregate liability shall not exceed the fees paid by you in the three months preceding the claim.

8. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
